Introduction
Purpose
The Access to Information Act (Revised Statutes of Canada, 1985, Chapter A‑1) was proclaimed on July 1, 1983.
The Access to Information Act gives Canadian citizens and permanent residents a broad right of access to information contained in government records, subject to certain specific and limited exceptions.
Section 94 of the Access to Information Act requires that the head of every government institution prepare, for submission to Parliament, an annual report on the administration of the Act within the institution during each financial year.
Section 20 of the Service Fees Act requires a responsible authority to report annually to Parliament on the fees collected by institutions.
This annual report is tabled in Parliament pursuant to section 94 of the Access to Information Act and section 20 of the Service Fees Act and describes how the Federal Economic Development Agency for Northern Ontario (FedNor) administered its responsibilities for the reporting period.
Institutional mandate
FedNor is the Government of Canada's economic development organization for Northern Ontario, and as such, it is key to helping deliver on the federal government's Prosperity and Growth Strategy for Northern Ontario.
Through its programs and services, and through its financial support of projects that lead to job creation and economic growth, FedNor works with businesses and community partners to build a stronger Northern Ontario.
FedNor has two main funding vehicles: the Northern Ontario Development Program, which focuses on community economic development, and the Regional Economic Growth through Innovation program, which focuses on business scale-up and productivity, and regional innovation ecosystems.
Through the Community Futures Program, FedNor also supports a network of 24 Community Futures Development Corporations (CFDCs) across Northern Ontario. These locally driven CFDCs provide business financing and services, as well as support for community-based economic development projects.
Also, as the need is determined and priorities change, FedNor delivers other Government of Canada programs designed to contribute to economic development in Northern Ontario. Recent examples include the Economic Development Initiative (EDI) for official language minority communities.
In addition to its efforts through these funding vehicles, FedNor is strongly focused on outreach and collaboration efforts that engage community leaders and stakeholders as we work to better meet the current and future needs of Northern Ontario. FedNor does this by identifying and actively co-leading important files including the emerging Ring of Fire mining development – considered a generational mining opportunity that could re-shape Northern Ontario's economy – as well as by collaborating with our federal partners to ensure Northerners have full access to the wide slate of programs and services offered by the Government of Canada.

On August 12, 2021, FedNor ceased to operate as an initiative of Innovation, Science and Economic Development Canada, and became a fully independent agency of the Government of Canada, led by the Honourable Patty Hajdu, Minister of Indigenous Services and Minister responsible for the Federal Economic Development Agency for Northern Ontario. At the time of this report, FedNor is also led and supported by President Valerie Gideon.

Organizational structure
For the purposes of the Access to Information Act (Act), the President of FedNor has delegated powers, duties and functions under the Act to the Manager of Government Affairs who performs the role of ATIP Coordinator responsible for leading the ATIP Program. The ATIP Coordinator administers the Act with assistance from an administrative officer.
The ATIP Coordinator is responsible for all daily ATIP activities and operations, as well as the development, coordination and implementation of effective policies, guidelines and procedures necessary to manage the agency's compliance with the Acts. The ATIP coordinator responds to all formal requests submitted under the applicable Act.
Delegation of authority
The President's Access to Information Delegation Order was updated on June 20, 2023. A copy of the Delegation Order is attached in Annex A. It provides delegated authority to the Vice President of Policy and Communications, the Director of Program Policy and the Manager of Government Affairs.
Performance
FedNor's 2023-2024 Statistical Report on the Access to Information Act is attached as Annex B. The following is an overview of key data on FedNor's performance for the fiscal year.
Requests received under the Access to Information Act
FedNor received three new requests during the reporting period. Two requests were processed and closed during the reporting period and one request was carried over to the next reporting period. Of the two requests closed, both were completed within their legislated timelines.
In 2023-24, one request required an extension between 181 and 365 days. The request was required to conduct an extensive search.
FedNor has no active complaints.
Consultations completed for other institutions
FedNor received four consultation requests from other Government of Canada departments. Of those four cases, four were completed during the reporting period. Two were processed within 1-15 days, one within 31-60 days, and one within 121-180 days. Of the four requests, all involved recommendations for records to be disclosed entirely.
Fees and operating costs
Access to information fees
The Service Fees Act requires a responsible authority to report annually to Parliament on the fees collected by the institution. With respect to fees collected under the Access to Information Act, the information that follows is reported in accordance with the requirements of section 20 of the Service Fees Act.
In accordance with the changes to the Access to Information Act that came into force on June 21, 2019, FedNor may only charge an application fee of $5, as set out in paragraph 7(1)(a) of the Regulations. Pursuant to the Directive on Access to Information Requests, issued on July 13, 2022, institutions can waive this application fee as deemed appropriate.
FedNor collected $10.00 to process two requests during the reporting period.
Operating costs
The cost of delivering FedNor's Access to Information program and services for 2023–2024 was $153,399, all of which were salary costs, equating to 0.297 full-time employees and 0.900 part time employees, when averaged over the year. There were no additional operating expenses.
Training and awareness
All FedNor employees are required to take the Canada School of Pubic Service course on Access to Information and Privacy Fundamentals. Between April 1, 2023 and March 31, 2024, 25 people completed the course.
Throughout the reporting period, the ATIP Coordinator provided ongoing advice and coaching to employees on access to information-related matters, as required.
Guidelines and procedures are provided to staff as part of the tasking documentation when they are tasked to respond to an access to information request.
Policy, guidelines, procedures, and initiatives
In 2023-24, FedNor set up its Access to Information and Privacy process. This included establishing internal tasking protocols and guidelines to ensure consistency across the agency. The Government Affairs unit continues to refine the processes to ensure compliance and consistency.
Proactive publication under Part 2 of the Access to Information Act
FedNor is a government institution listed in Schedule I.1 of the Financial Administration Act and complies with the proactive publication requirement under Part 2 of the Access to Information Act.
The Government Affairs unit at FedNor collaborates with Corporate Services to ensure that all proactive disclosure requirements are met. It should be noted that during the reporting period, the Minister responsible for FedNor was the Minister of Indigenous Services Canada. Consequently, the responsibilities for proactive publication under sections 75-78 of the Act, fell to Indigenous Services.

Initiatives and Projects to Improve Access to Information
FedNor did not undertake any initiatives or projects to improve Access to Information.
Key issues and actions taken on complaints
There were no complaints received concerning the administration of the Access to Information Act, and no audits, investigations or appeals to the Federal Court were undertaken.
Monitoring compliance
Response rates are monitored on an ongoing basis to ensure that responses are within allowable periods. The ATIP coordinator provides regular updates to senior management on active requests.

The President, pursuant to section 95 of the Access to Information Act and section 73 of the Privacy Act, hereby designates the persons holding the positions set out in the schedule hereto, or the persons occupying on an acting basis those positions, to exercise the powers, duties and functions of the President as the head of the Federal Economic Development Agency for Northern Ontario, under the provisions of the Acts and related regulations set out in the schedule opposite each position. This delegation replaces all previous delegation orders.
