2024-2025 Annual Report on the Administration of the Access to Information Act


Introduction

The Access to Information Act gives Canadian citizens and permanent residents a broad right of access to information contained in government records, subject to certain specific and limited exceptions.

Section 94 of the Access to Information Act requires that the head of every government institution prepare, for submission to Parliament, an annual report on the administration of the Act within the institution during each financial year.

This annual report is tabled in Parliament pursuant to section 94 of the Act and describes how the Federal Economic Development Agency for Northern Ontario (FedNor) administered its responsibilities for the reporting period.

Institutional mandate

FedNor is the Government of Canada's economic development organization for Northern Ontario, and as such, it is key to helping deliver on the federal government's Prosperity and Growth Strategy for Northern Ontario.

Through its programs and services, and through its financial support of projects that lead to job creation and economic growth, FedNor works with businesses and community partners to build a stronger Northern Ontario.

Organizational structure

For the purposes of the Access to Information Act (the Act), the President of FedNor has delegated powers, duties and functions under the Act to the Manager of Government Affairs, who, among other responsibilities, serves as the Access to Information and Privacy (ATIP) Coordinator responsible for leading the ATIP Program. The ATIP Coordinator administers the Act with assistance from an administrative officer.

The ATIP Coordinator is responsible for all daily ATIP activities and operations, as well as the development, coordination and implementation of effective policies, guidelines and procedures necessary to manage the agency's compliance with the Acts. FedNor ensures compliance with the Act through a collaboration between the ATIP Coordinator and a liaison officer in each sector who coordinates the records-retrieval process.

FedNor has no new or preexisting service agreement under section 96 of the Access to Information Act.

Delegation of authority

A copy of the Delegation Order is attached in Annex A. It provides delegated authority to the Vice President of Policy and Communications, the Director of Program Policy and the Manager of Government Affairs (the ATIP Coordinator).

Performance for 2024−2025

FedNor’s 2024-2025 Statistical Report on the Access to Information Act is attached as Annex B. The following information provides an overview of key data on FedNor’s performance in administering part 1 of the Act for the fiscal year. The term “requests” here refers to formal requests under the Act.

FedNor received and processed two new requests during the reporting period. In addition, one request was carried over from the previous reporting period. One of the two requests received in 2024−2025 was processed within the 30 days allowed by the Act. The second request required an extension of 61 to 120 days to proceed with consultations to complete the review of the records. The request that was carried over from the previous reporting period required an extension of 181 to 365 days because of the large number of documents involved in the request. All (100%) of the requests were processed within the delays prescribed by the Act.

Of the three requests closed in 2024−2025, records were all disclosed for one request (33.33%) and disclosed in part for the other two requests (66.67%).

Two consultation requests were received from other Government of Canada institutions; both were completed by FedNor within 15 days. The agency recommended that the records be disclosed in their entirety to one response, and that the records be disclosed in part in the other response.

There were no active requests or complaints as of the last day of the reporting period.

Training and awareness

To date, a total of 67 people completed the previously mandatory Access to Information and Privacy Fundamentals course offered by the Canada School of Public Service. FedNor will continue to require that all employees complete the course.

Informal briefings were provided to FedNor employees responsible for the publication of documents mentioned under sections 82 to 85 under Part 2 of the Access to Information Act.

Throughout the reporting period, the ATIP Coordinator continued to provide information to FedNor employees on their responsibilities as it relates to the processing of informal access requests or formal requests submitted pursuant to the Act.

Policies, guidelines and procedures

FedNor established internal tasking protocols, and guidelines on the records-retrieval process to ensure consistency across the agency. The Government Affairs unit continues to refine all processes related to the administration of the Access to Information Act to ensure compliance and consistency.

No guidelines or procedures were implemented during the reporting period by FedNor to meet proactive publication requirements under Part 2 of the Act.

Initiatives and projects to improve Access to Information

FedNor has drafted procedures to assist employees involved in the processing of access to information requests in 2024−2025.

Summary of key issues and actions taken on complaints

No complaints were received or concluded regarding the administration of the Access to Information Act during the reporting period.

Proactive publication under Part 2 of the ATIA

The Government Affairs unit at FedNor collaborates with Corporate Services and Program Delivery to ensure that all proactive disclosure requirements are met. It should be noted that during the reporting period, the Minister responsible for FedNor was the Minister of Indigenous Services Canada. Consequently, the responsibilities for proactive publication under sections 75-78 of the Act, fell to Indigenous Services Canada.

Monitoring compliance

Response rates to access requests are monitored on an ongoing basis to ensure that they are provided within legislated timelines. The ATIP coordinator provides regular updates to senior management on active requests.

All FedNor contracts contain a sentence indicating that all contracts are subject to the Access to Information Act and the Privacy Act.

FedNor has no information sharing agreement or arrangement in place.

The ATIP Coordinator is working on establishing a process to monitor the timeliness, accuracy and completeness of requirements related to proactively published information under Part 2 of the Act. The monitoring will occur on a monthly or quarterly basis.
